Revocable Authorization and Agreement to Access Security Camera Footage
I. INTRODUCTION
This Revocable Authorization and Agreement to Access Security Camera Footage (“Agreement”), authorizes Peyton C. Grinnell, Lake County Sheriff, Florida (“Sheriff”) to access the security camera(s) and camera footage owned by owner (“Owner”).
II. PREAMBLES
WHEREAS, Sheriff is a law enforcement organization responsible for the preservation of safety and security in the geographic area in which the Sheriff has jurisdiction.
WHEREAS, Owner owns a security camera or cameras within the jurisdiction of the Sheriff.
WHEREAS, Owner and Sheriff acknowledge that access to Owner’s camera(s) could assist in preventing and solving crimes.
THEREFORE, Owner agrees to permit the Sheriff access to owner’s camera(s) under the terms and conditions set forth herein.
III. RESPONSIBILITIES OF SHERIFF
Sheriff will only access video sources designated by Owner for fusion into video fusion software. The Sheriff will access video and video sources only when Sheriff deems appropriate in Sheriff’s sole and absolute discretion.
IV. RESPONSIBILITIES OF OWNER
Owner grants video access to Sheriff to video sources designated by Owner that are owned by Owner. Cameras shared must also be approved by Sheriff as appropriate for sharing and deemed useful.
Owner will provide Sheriff at least one point of contact with a basic understanding of Owner’s inventory and locations of surveillance cameras as may be required for video sharing. Owner will provide information needed by the Sheriff for the system to operate, including but not limited to, camera make, model, IP address, and Camera and/or associated DVR/NVR login information.
V. LIMITATION OF LIABILITY
It is neither intended nor expected that Owner’s camera(s) will be routinely monitored in real-time by Sheriff. Video access by Sheriff does not constitute commitment on the part of Sheriff that video will be viewed in emergencies or when requested by Owner. IN NO EVENT WILL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY DAMAGES, INCLUDING INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST REVENUES, PROFITS, OR GOODWILL, FOR ANY MATTER ARISING OUT OF OR IN CONNECTION WITH THE PERFORMANCE OR NONPERFORMANCE OF THIS AGREEMENT. THE SHERIFF DOES NOT WAIVE SOVERIEGN IMMUNITY.
VI. EFFECTIVE DATE, TERMINATION AND AMENDMENTS
This Agreement shall take effect upon signing by both parties and shall remain in effect for a period of five (5) years from that date unless earlier terminated. Neither party may assign or transfer all or any portion of this Agreement without the prior written consent of the other party.
The Agreement may be renewed at the end of this period by mutual written agreement by both parties.
The provisions of this Agreement may only be amended or waived by mutual written agreement by both parties.
Either party may terminate this Agreement and any related agreement at any time and for any reason or no reason by giving written notice to the other party.
The individuals signing this Agreement on behalf of their respective entities represent and warrant that upon the signature of each, this Agreement shall have been duly executed by the entity each represents.
This Agreement embodies the entire and complete understanding and agreement between the parties and there are no other terms unless expressly stated herein.
